Abstract

This study aims to determine the mechanism for implementing the management of state confiscated objects and state seized goods at Rupbasan Kendari and the obstacles that arise in the implementation of the management of state confiscated objects and state seized goods at Rupbasan Kendari. The study was conducted in Kendari City, precisely at the Rupbasan Class I Kendari Office. This study uses descriptive research because the data obtained in the field is presented descriptively using the empirical normative approach method. Based on the analysis of the data and facts that the author has obtained, the author concludes, among others: a) Confiscated goods that have not been auctioned or have been auctioned (replacement money for evidence) are returned to the person or to those from whom the object was confiscated, or to the person or to those who are most entitled if the interests of the investigation and prosecution no longer require it, the case is not prosecuted because there is insufficient evidence or it turns out not to be a crime, and the case is set aside for the public interest or the case is closed by law, except if the object is obtained from a crime or used to commit a crime. ; b) The obstacles that arise in Rupbasan are that human resources, facilities and infrastructure related to buildings and budgets to support the function of Rupbasan are still limited, there is a perception that Rupbasan is not yet capable of managing confiscated objects, and there is no common perception among the public regarding Rupbasan.
