Abstract

This study aims to determine the criminal law policy on the requirements for granting remission to prisoners and the obstacles faced in granting remission to prisoners. The study was conducted in Kendari City, precisely at the Kendari Class IIa Prison Office. This study uses descriptive research because the data obtained in the field is presented descriptively using the empirical normative approach method. Based on the analysis of the data and facts that the author has obtained, the author concludes, among others: a. Fulfillment of the right to reduce the sentence (remission) is in accordance with existing laws and regulations. However, based on the results of the study, the fulfillment of the right to reduce the sentence (remission) still needs to be improved, such as providing an explanation to prisoners about the requirements for obtaining remission and creating a conducive environment so that nothing happens that can prevent prisoners from getting remission.; b) One of the factors that hinders the fulfillment of the right to reduce the sentence (remission) is the prisoner himself, because one of the requirements for getting a reduction in sentence (remission) is that the prisoner must behave well. Meanwhile, from the research results, most prisoners are hampered by the attitude of unwillingness to be good and also the absorption capacity in receiving educational guidance that varies from prisoner to prisoner. Correctional Institutions must continue to strive to improve moral and psychological mental development of prisoners, so that they can think healthily which results in a conducive environment. All important components in prisoner development (prisoners, families, prison officers and the community) must work together and provide information to each other so that prisoner development can run well. The relationship between prisoners and prison officers with prisoners must continue to run well and help maintain a conducive environment.
