TINJAUAN YURIDIS TINDAK PIDANA PEMBUNUHAN YANG DILAKUKAN OLEH ANAK (Suatu Studi di Pengadilan Negeri Kendari)

Abstract

The objectives of the study were: 1). To determine the factors causing the occurrence of criminal acts of murder committed by children. 2). To determine efforts to prevent the occurrence of criminal acts of murder committed by children. This study was conducted in Kendari City, namely at the Kendari Police, using the type of research, namely normative empirical. The data collection method used was document study, field surveys and interviews using qualitative descriptive analysis. Based on the results of the study, it can be seen: 1). The factors causing the occurrence of criminal acts of murder committed by children are the emergence of a sense of revenge, because Duma (the perpetrator) felt annoyed, namely starting from Duma's annoyance towards Yoga who often insulted him with the words "bastard, bastard", then Duma got emotional and committed the act of killing someone named Yoga. 2). Efforts to prevent the occurrence of criminal acts of murder committed by children require stability of security and order in society and are the responsibility of all parties, understanding this, the Police, as well as other related agencies such as the Prosecutor's Office and the Court also have a big role in efforts to create a safe and orderly atmosphere of community life. Repressive efforts against the crime of murder must be carried out with firm action in accordance with the Criminal Code without looking at who the perpetrator of the crime is, this effort is carried out by competent law enforcers such as the Police, Prosecutors and Judges through the case process against a criminal act, but in the efforts to take action, there is an aspect of coaching the suspect/convict without sacrificing the essence of the application of sanctions according to applicable regulations.
