TINJAUAN YURIDIS AKIBAT HUKUM AMAR PUTUSAN TANGGUNG RENTENG PADA PENGADILAN NEGERI KENDARI (Suatu Studi di Pengadilan Negeri Kendari)
Abstract
This study aims to determine the consequences of the joint liability verdict at the Kendari District Court and the most appropriate legal steps taken by the plaintiffs in the a quo case in order to enjoy their rights that have been granted by the state through the joint liability verdict at the Kendari District Court. The study was conducted in Kendari City, precisely at the Kendari District Court Office. This study uses descriptive research because the data obtained in the field are presented descriptively using the empirical normative approach method. Based on the analysis of the data and facts that the author has obtained, the author concludes, among others: a. the legal consequences of the joint liability verdict at the Kendari District Court, give rise to a legal relationship which includes the rights and legal obligations between the plaintiffs and the defendants in the form of obligations for the defendants to complete their achievements until the implementation of the decision that has permanent legal force and vice versa the rights of the plaintiffs are to obtain achievements for things that are the obligations of the defendants. Meanwhile, the legal relationship between the defendants is the right and obligation to implement the verdict, including the rights and obligations attached to the joint liability agreement. b) The most appropriate legal effort taken by the defendants to enjoy their rights that have been granted by the state through a court decision is to file an execution application addressed to the Head of the Kendari District Court so as to open up space for the court's authority to carry out execution against the defendants to fulfill their obligations in their entirety
