TINJAUAN HUKUM TERJADINYA SERTIFIKAT GANDA ATAS SEBIDANG TANAH HAK MILIK (Suatu Studi di Kabupaten Konawe Selatan)

Abstract

This study aims: 1) To find out and understand the factors causing the emergence of dual certificates for a plot of land and to find out and understand the legal protection of land rights holders due to dual certificates. This study was conducted at the Land Office of South Konawe Regency. This study uses a normative approach by analyzing data that refers to legal norms outlined in laws and regulations, especially those relating to legal review in dual certificates and in addition we also see the realities that occur in society regarding land disputes and dual certificates The results of this study indicate that the causal factors for the occurrence of dual certificates are due to the existence of registration maps that are not yet in form or are not complete and also due to the inaccuracy and carelessness of the land office in examining and examining physical data and legal data. While in the form of protection and guarantees of legal certainty over land ownership it is stated in Article 19 paragraph 1 that in order to guarantee legal certainty by the government, land registration is carried out throughout the territory of the Republic of Indonesia which is perfected in Government Regulation Number 24 of 1997 concerning Land Registration.
