Abstract

This study aims to determine the criminal liability of the Damri public company for traffic accidents that cause fatalities. The type of research used in this writing is normative legal research. Based on the analysis of the data and facts that the author has obtained, the author concludes, among others, that the resolution of serious traffic accidents with a restorative justice approach as an alternative model for resolving criminal acts of traffic violations at the Pontianak City Police Resort is carried out by forgiving each other by both parties, then the party that hit the victim agrees to provide compensation to the victim, and makes an agreement, namely that one party is willing to provide compensation according to the agreement. The victim is willing to undergo restorative justice because an accident is a disaster for road users. No one wants this problem so this settlement is considered fair. The parties make a written peace that has been known by the Village Head where the victim is domiciled, then the letter is submitted to the Traffic Accident investigator that both parties in the traffic accident case want to be resolved amicably.
