AKIBAT HUKUM PENERBITAN SURAT KETERANGAN CATATAN KEPOLISIAN (SKCK) BAGI MANTAN NARAPIDANA
Abstract
This study aims to determine and analyze the regulations governing the issuance of Police Record Certificates (SKCK) for former convicts and the Legal Consequences arising from the Issuance of Police Record Certificates (SKCK) for Former Convicts. The research carried out was field research, namely the researcher went directly to the research location to collect data by conducting interviews with the authorities and the community, in addition, this study also used a library research method, namely reviewing various reading materials / books related to the title of the research in question. The results of the research conducted by the author found the fact that "Having or not committed a crime" is not a requirement to obtain an SKCK. SKCK is actually an official police certificate containing the results of research on biodata and police records that exist about you, including whether or not you have committed a crime. The issuance of a Police Record Certificate (SKCK) for former convicts in Indonesia has several legal consequences, both for the former convicts themselves and for the parties authorized to issue it. However, if a former convict falsifies data in making a SKCK, then he can be charged with Article 263 of the Criminal Code concerning Forgery.
